Article 2. Definitions

  • Code: the code you receive with an order and with which you start a trail.
  • Team: a group of players who together use one place on the code.
  • Place: the right for one team to play the trail once. An order has as many places as the number of teams you buy.
  • Buyer: the person who places and pays for the order.
  • Player: everyone who takes part, even if they did not pay themselves.
  • Trail: the puzzle trail that you play in your browser, on location, with tasks, a story and, at the end, a report.
  • Stop: one part of the trail at a particular location, with the tasks there.
  • Completed: the team has reached the finish of the trail.
  • Competition: two or more teams playing the same trail against each other at the same time.
  • City battle: a competition with a game master.
  • Game master: the person who follows a city battle with a separate key and can intervene.
  • Dare challenge: a task for adults in which the team makes a short video as proof.
  • Consumer: a buyer who is not acting for a business or profession.

Article 3. What these terms apply to

3.1 These terms apply to every order of a code on puzzeltocht.doenwe.events and to playing the trail.

3.2 If you do not buy as a consumer, they also apply, with the deviations in article 16.

3.3 These terms exist in Dutch, English and German. All versions are equally valid. If they differ on a point, the version that is most favourable to you as a consumer applies.

3.4 If we agree something that deviates from these terms, we confirm it by email or in a quotation.

Article 4. Offer and price

4.1 The page of each trail states what you get: where the trail takes place, the starting point, roughly how long it takes, how far you walk, for how many players per team it is intended, from what age it is suitable, in which language you play it, and the price.

4.2 Prices are per team, in euros and include VAT. No further costs are added.

4.3 If the offer contains an obvious error, such as a price that cannot be right, we are not bound by it. If you have already paid, you get your money back.

4.4 We do not refuse anyone on grounds of nationality, place of residence or place of establishment, and we do not charge a different price for that.

Article 5. Ordering, payment and confirmation

5.1 An order takes four steps:

  1. On the trail's page you choose how many teams you want.
  2. You read these terms and the privacy statement. With two tick boxes you agree to these terms and ask to be able to use the code immediately (see article 8.2).
  3. You pay in the Stripe payment window, with iDEAL, a credit card or another payment method shown there. Stripe asks for your name and email address.
  4. After a successful payment you receive the confirmation with your code.

5.2 Before you pay, you see an overview of the trail, the number of teams and the total amount. If anything is wrong, go back and change it. In the payment window you can correct your details until you press the pay button.

5.3 The button with which you pay makes clear that doing so creates an obligation to pay. The contract is concluded at the moment your payment has succeeded.

5.4 Immediately after payment you receive an email with your code, the trail, the number of teams, the amount and the date of your order, the confirmation that you asked to be able to use the code immediately and knew when you lose your right of withdrawal (article 8.2), and these terms and the model withdrawal form as attachments. Keep that email. If you do not receive it, check your spam folder and then email us; we will send it again.

5.5 We keep your order for seven years after the end of the year in which you ordered, because tax law requires it. If you want a copy of your order or of the terms that applied at the time, email us.

5.6 You can order in Dutch, English and German: the language in which you view the site. You play the trail itself in the language stated on the trail's page.

Article 6. The code

6.1 You receive one code for the whole order. Each team starts the code on its own phone; it works on as many phones as the number of teams you have bought. Within a team, extra phones can join via that team's phone.

6.2 The code is valid for one year, counted from the day of purchase. Within that year you choose when to play. After that, places that have not been used lapse.

6.3 A trail that you have started can be interrupted and continued later on the same phone.

6.4 If we stop offering a trail while you still have unused places on a valid code, you choose: a code for another trail, or your money back for those places.

6.5 The code is for your group. Do not resell it: whoever uses your places uses them up.

6.6 If you have lost your code, email us from the email address of the order. We will send it again.

6.7 We may change a trail if there is a good reason, such as roadworks, safety, a missing sign or a better task. That costs you nothing. If the trail becomes clearly worse for you as a result, we will email you beforehand. You can then terminate the contract free of charge within 30 days for the places you have not yet used; we will refund those.

Article 7. What you need

7.1 Per team you need:

  • a smartphone with a recent browser, such as Safari or Chrome;
  • mobile internet throughout the whole trail;
  • location services switched on;
  • for photo tasks: a camera;
  • for tasks in which you say something out loud: a microphone;
  • for compass tasks: a compass in your phone, and on an iPhone permission for motion and orientation;
  • a charged battery: the trail uses internet and location the whole time. For a long trail, bring a power bank.

7.2 You do not need to install an app. You receive updates automatically, as long as your code is valid.

7.3 If your phone lacks a component from 7.1, part of the trail will not work. Where possible, the trail offers an alternative; for example, without a compass you get a distance question instead of a direction question. So check before you buy whether your phone meets 7.1.

Article 8. Withdrawal period and withdrawing from the contract

8.1 If you buy as a consumer, you have a withdrawal period of 14 days. It starts on the day after your payment has succeeded. Within that period you can withdraw from the contract without giving a reason.

8.2 When ordering you expressly ask us to deliver the code immediately, so that you can already play within the withdrawal period. In doing so you acknowledge that you lose your right of withdrawal as soon as the trail has been played in full. If you bought for more teams, this applies per team: you lose the right of withdrawal only for the place of a team that has completed the trail.

8.3 What you get back if you withdraw from the contract depends, per place, on how far that team has got:

Per placeRefund
Team has not yet startedThe full amount for that place
Team has started, trail not yet completedThe team price, minus the team price × completed stops ÷ the number of stops stated on the trail's page
Team has completed the trailNothing; the right of withdrawal for that place has been lost

Example: a trail of 25 stops costs €20 per team and your team completed 5 of them. You pay €4 and get €16 back.

8.4 This is how you withdraw from the contract:

  • with the ‘Withdraw from contract here’ button at the bottom of every page. You enter your name, your email address and the code or order number and confirm. You immediately receive a confirmation by email, with date and time;
  • or you send the model form from the appendix, or a message of your own with the same details, by email or by post to the addresses in article 1. The form is not mandatory.

You are in time if you send your withdrawal before the end of the withdrawal period.

8.5 We refund within 14 days after we have received your withdrawal, using the same payment method and free of charge. Places for which you get money back no longer work afterwards.

8.6 After the withdrawal period you can no longer return unused places. They remain valid until one year after purchase (article 6.2); article 6.4 and article 13 apply to the discontinuation of a trail and to faults.

Article 9. Playing safely

9.1 You play in public space, among traffic and other people, and you are yourself responsible for how you behave there. Traffic rules always come before a task. Do not look at your screen while crossing the road or cycling.

9.2 Do not enter private property, do not climb on anything and do not do anything that does not feel safe. No task asks you to break a rule or take a risk. If a task seems to ask that anyway, skip it and tell us.

9.3 You can also play the trails in the evening. In the dark, keep in mind that kerbs, cyclists and traffic are harder to see; wear something light-coloured or reflective.

9.4 The trail's page states the distance, the duration and from what age it is suitable. You judge for yourself whether the trail suits your fitness and the weather.

9.5 If children take part, an adult comes along to look after them.

9.6 Be considerate of the people who live and work there. Do not make noise, do not leave anything behind and do not damage anything. Do not photograph people who do not want that.

9.7 Dare challenges only appear in trails that are marked as such on the trail page, and are only for players aged 18 and over. The following applies:

  • the buyer ensures that only adults take part in a team that plays dare challenges, and the team confirms in the trail that all players are 18 or older;
  • do not involve passers-by and do not film anyone who is not taking part;
  • nobody stands on another person or on top of anything;
  • no task asks for alcohol: if a task asks for a drink, an alcohol-free drink always counts.

9.8 If a team puts others in danger, harasses others, misuses the trail or the app, manipulates the score or lets minors take part in dare challenges, we can deny that team access to the trail. For other breaches of this article, we do so only after a warning. You then get back the part of the team price for the stops that the team had not yet completed, calculated as in article 8.3.

Article 10. AI in the trail

10.1 The trail contains artificial intelligence (AI) from Google, called Gemini. AI gives hints, conducts the conversations with characters, assesses photos and, for dare challenges, frames from the video, steers the game if a team gets stuck, writes the commentary in a city battle and writes the report at the end. For every part that uses AI, the trail states that it is AI.

10.2 What AI says and decides is generated automatically and may be wrong. Characters are fictional; what they tell you is part of the game. The report is a keepsake, not an account of reality, and may contain inaccuracies.

10.3 AI only decides about points, hints and the course of the game, never about anything with consequences outside the game.

10.4 If you think a judgment is unfair, email us. Within 14 days a person will look at it and adjust the points if necessary.

10.5 We never ask the AI to recognise anyone, compare faces or estimate anyone's age, gender or emotion. Tasks are about what is in a photo or video, not about who.

10.6 Do not try to make AI say something hurtful or inappropriate. If that happens, we can stop the conversation or the task.

Article 11. Photos, videos, texts and team names

11.1 Photos and videos that you make remain yours.

11.2 You give us the right to use them as far as the trail needs: storing them, having AI assess them, showing them to your own team, also at the end of the trail and on the look-back, showing them to the other teams in the same competition for a task that teams do together, and incorporating them in your team's travel booklet and route video. That right is free of charge and non-exclusive, and lasts as long as we keep the images in accordance with the privacy statement. For other purposes, such as advertising, we ask your permission separately.

11.3 You declare that you are allowed to make and upload the images: that you do not infringe anyone else's rights with them, and that everyone recognisable in the picture agrees to it.

11.4 Images, texts and team names that are hurtful, discriminatory, sexual, violent or unlawful are not permitted. We remove such images and texts and replace such team names. If we have an email address for the team, we let it know why.

11.5 If you see something that does not belong, report it via support@doenwe.events. We assess every report and let you know what we did with it.

11.6 If you want us to delete images earlier, email us.

Article 12. What others see, and competitions

12.1 Your team name, points and time appear on the trail's scoreboard. In a competition they also appear in the interim standings, and in a city battle also in the commentary for all teams. After twelve months only the score remains, as an anonymous team.

12.2 The scoreboard, the team passport and the look-back on your trail each have their own link. Anyone with that link can open them; search engines do not index them. The look-back also shows your photos, until we delete them after thirty days. If you don't want that, switch it off at the end of the trail. Share the link only with those who may see it, and choose a team name without surnames.

12.3 In a city battle the buyer receives a game master key. The game master sees the teams, their points and requests for help and, if he is not playing himself, where they are. Every intervention by the game master, such as awarding points or pausing a team, appears with his explanation in a log that all teams can read.

12.4 In a task that teams do together, the other teams in the competition see your photo and read what you write, with your team name next to it; this also appears in the report of the competition. In a competition, teams can also influence each other with special abilities. With the binoculars an opponent briefly sees where your team is. Teams in a competition also see each other's progress, and an opponent can sometimes briefly watch along with you.

12.5 If you buy the code for a group, tell the players about these terms and the privacy statement beforehand.

Article 13. If it does not work

13.1 You are entitled to a trail that works as we described it. Your statutory rights if the service does not conform to the contract remain fully intact; this article does not limit them.

13.2 If the trail does not work as we described it, email us as soon as possible. We will put it right free of charge, within a reasonable time. If that fails, you choose: a new code, part of your money back in proportion to what did not work, or, if the problem is not minor, all of your money back.

13.3 If a trail is temporarily unplayable because of a fault, even if that fault lies with one of our service providers, we extend the validity of your code by the duration of the fault.

13.4 Problems with your own phone, internet connection or GPS are outside our control. The trail remembers where you were, so that you can carry on later.

13.5 Public space changes: roadworks, a closed street, a missing sign. If you cannot do a task because of that, skip it and tell us; we will adjust the trail. If your team misses points because of that, we will correct them at your request.

Article 14. Liability

14.1 We are liable for damage that is the result of a failure that can be attributed to us, or of an unlawful act by us.

14.2 We are not liable for damage to the extent that it is caused by you not following the traffic rules or article 9, by your own phone or connection, by what others do in public space, or by a change in public space that we did not know about and did not have to know about.

14.3 Mandatory statutory rules that protect you as a consumer take precedence over this article.

Article 15. Intellectual property

15.1 The trails, puzzles, stories, characters, texts, images and the app belong to us, or to whoever licensed them to us.

15.2 You may use them to play the trail with your team. You may share your own photos, the travel booklet and the route video of your team privately and on your own social media.

15.3 You may not copy or resell the trail, publish the solutions, or use it for a trail of your own or a commercial purpose. You may not take the app apart, overload it or read it out automatically, and you may not circumvent the limit on the code.

Article 16. Business customers

16.1 If you do not buy as a consumer, for example for a company, association or school, these terms apply with the deviations below, unless the quotation says otherwise.

16.2 You have no withdrawal period; article 8 does not apply.

16.3 If you pay by invoice, the payment term from the quotation applies, and without an agreement 14 days after the invoice date.

16.4 Our liability is limited to the amount of the order, except in the case of intent or deliberate recklessness and in the case of death or injury. We are not liable for indirect damage, such as lost profit.

16.5 If you use the trail for employees, you inform them beforehand about these terms and the privacy statement, and taking part is voluntary. We remain responsible for the game data. You do not receive results per player from us: only what is visible to everyone in the competition, and what the game master sees (article 12.3).

Article 17. Complaints

17.1 If you are dissatisfied with something, email us via support@doenwe.events, preferably as soon as possible after you noticed it. We respond substantively within 14 days.

17.2 We are not affiliated with a dispute committee and have not committed ourselves to a code of conduct. If we cannot work it out together, you can go to court. If you live in another country of the European Union, the European Consumer Centre in your own country can help you.

Article 18. Governing law and competent court

18.1 Dutch law applies to these terms and your order. If you live in another country as a consumer, you keep the protection that the mandatory rules of that country give you.

18.2 As a consumer you can bring a dispute before the court in the Netherlands or in the country where you live. We can only bring a dispute with you before the court of the country where you live.

18.3 For business customers, the Noord-Nederland District Court has jurisdiction.

Article 19. Changes

19.1 We may change these terms. For your order, the terms you accepted when paying remain applicable; they are attached to your confirmation email. The version number is at the top.

Article 20. Privacy

20.1 How we handle your data is set out in the privacy statement on our website.

Article 21. Invalid provision

21.1 If a provision of these terms is void or is annulled, the other provisions remain in force.

Appendix. Model withdrawal form

Complete and return this form only if you wish to withdraw from the contract. You can also use the ‘Withdraw from contract here’ button on the website.
